• 1. Scope

  These terms and conditions ("Terms of Use" or "Agreement") set forth the rights and obligations for accessing and using the VitrA Smart Application (hereinafter referred to as the "VitrA Smart Application") provided by Eczacıbaşı Yapı Gereçleri Sanayi ve Ticaret A.Ş., Esentepe Mahallesi, Büyükdere Cad. Ali Kaya Sok. No:5 Şişli, Istanbul ("VitrA").

• 2. Acceptance of Terms of Use
  • 2.1. The Application is provided for personal and non-commercial use only.
  • 2.2. By installing and using the Application, the User enters into an agreement with Eczacıbaşı Yapı Gereçleri Sanayi ve Ticaret A.Ş. regarding the use of the VitrA Smart Application and related services ("Agreement").
  • 2.2. Registration is completed when the user enters the confirmation code sent via email or clicks the confirmation button (e.g., "Sign In") after authenticating through social login (currently Google).
  • 2.3. These Terms of Use apply only to this app. The user’s own terms are not binding unless expressly accepted in writing by Eczacıbaşı Yapı Gereçleri Sanayi ve Ticaret A.Ş.
  • 2.4. Repeated registrations are not permitted. Creating accounts for third parties is prohibited. The minimum age for use is 18 years.

• 3. Obligations of Eczacıbaşı Yapı Gereçleri Sanayi ve Ticaret A.Ş.
  • 3.1. The application and services are provided within the availability scope set out in Article 6.
  • 3.2. Services/functions may change, provided that such changes do not significantly reduce the scope at registration or negatively affect the usability of connected VitrA devices.
  • 3.3. Use is subject to technical requirements listed at this page. Meeting these requirements is the user’s responsibility.

• 4. User Obligations
  • 4.1. The user has the following obligations:
    • 4.1.1. Provide accurate and up-to-date data, including contact information.
    • 4.1.2. Store account login details securely.
    • 4.1.3. Bind only personally used devices to their account.
    • 4.1.4. Remove any device no longer in use without undue delay.
    • 4.1.5. Use the app in compliance with these Terms and applicable laws.
  • 4.2. Failure to comply may result in suspension or termination of the account without prior notice.

• 5. Intellectual Property Rights

  All content, trademarks, and logos belong to Eczacıbaşı Yapı Gereçleri Sanayi ve Ticaret A.Ş. Unauthorized copying, modification, distribution, or commercial use is prohibited.

• 6. Availability

  Services are provided "as is" without warranty. Interruptions due to maintenance are not considered availability failures. Reasonable notice will be given where possible.

• 7. Limitation of Liability
  • 7.1. Full liability applies in cases of:
    • 7.1.1. Intent or gross negligence.
    • 7.1.2. Damage to life, body, or health.
    • 7.1.3. Liability from warranty.
  • 7.2. Otherwise, liability is limited to foreseeable damages resulting from a breach of essential obligations.
  • 7.3. These limitations also apply to representatives, directors, employees, and agents.
  • 7.4. No liability for force majeure (e.g., strikes, natural disasters, official prohibitions).

• 8. Changes

  This Agreement may be updated. Continued use constitutes acceptance of the updated Terms.

• 9. Term, Termination
  • 9.1. Effective upon installation and indefinite.
  • 9.2. The user may terminate by deleting the account and the app.
  • 9.3. The company may terminate without cause, with 30 days’ prior notice.
  • 9.4. Termination for just cause remains reserved.
  • 9.5. Material or repeated breach allows termination for cause.
  • 9.6. Termination results in permanent deactivation of the account.

• 10. Data Protection

  Personal data is processed as part of normal operation. Details are provided in the Privacy Policy.

• 11. Electronic Messages

  The company may send communications regarding similar products or user experiences via email or in-app messaging. Users can opt-out at any time.

• 12. Final Provisions

  This Agreement is governed by the laws of the Republic of Turkey. For more information, contact the company via the App or website channels.
